Acceptance of These Terms
These Terms of Use apply to your use of the Pint Sized Productions website and to inquiries and bookings made through it. By using this site, you agree to these terms. If you do not agree, please do not use the site. When you book a project, your signed contract or written agreement with us controls if it conflicts with these terms.
Our Services
Pint Sized Productions provides photography, videography, and branded media services, including brand films, commercial and editorial photography, event coverage, and creative direction. Descriptions, sample work, and starting prices on this site are for general information and are not a binding offer. Final scope, deliverables, timelines, and pricing are set in your written estimate or agreement.
Booking, Estimates, and Payment
- Estimates are based on the information you provide and are valid for the time stated on the estimate.
- A date is reserved only after we receive a signed agreement and the required retainer or deposit.
- Deposits and retainers secure your date and our preparation time and are generally non-refundable, unless your agreement says otherwise.
- Remaining balances are due as stated on your invoice, usually before final delivery.
- Added scope, extra hours, rush editing, travel, or additional revisions may be billed as described in your estimate or agreement.
Cancellations and Rescheduling
Life happens. If you need to reschedule, let us know as early as you can and we will do our best to find a new date. Your deposit can usually be applied to a rescheduled date within a reasonable time, subject to availability. Cancellations close to the session date may result in loss of the deposit and may include costs already spent, such as rentals, travel, or crew. If we ever need to cancel because of illness, emergency, or unsafe conditions, we will work with you to reschedule or refund amounts paid for services not provided.
Your Responsibilities as a Client
To help your project run smoothly, you agree to:
- Give us accurate information about your project, schedule, and contacts.
- Secure permission to shoot at locations you choose or control, including any required permits, unless we agree in writing to handle them.
- Make sure the people you bring to a shoot, such as employees, talent, or guests, have agreed to be photographed or filmed.
- Provide logos, music, footage, and other materials only if you have the rights to use them.
- Keep the set reasonably safe and follow our crew's safety directions during production.
Copyright and Ownership
Unless a written agreement signed by both parties says otherwise, Pint Sized Productions owns the copyright in all photographs, video, footage, and other creative work we produce, including raw files and edits. Copyright transfers only through a signed written agreement.
Unedited raw files and outtakes are not part of standard deliverables unless your agreement includes them.
Your License to Use Deliverables
Once paid in full, you receive a license to use your final deliverables for the purposes described in your agreement.
- Personal clients receive a personal, non-commercial license to print, share, and post the images and videos, for example on personal social media.
- Business clients receive a license for the commercial uses agreed in writing, such as your website, social media, and marketing.
- Advertising, paid media, broadcast, resale, or use by third parties may need an expanded license.
- Please do not alter the work in a way that misrepresents it, remove watermarks from proofs, or claim the work as your own creation. Giving us credit when you share is always appreciated.
Any license is non-exclusive and non-transferable unless your agreement says otherwise.
Portfolio and Marketing Use
We love showing our work. Unless you opt out in writing before your session, you agree that we may use selected images, clips, and behind-the-scenes content from your project in our portfolio, website, social media, award entries, and promotional materials, with credit to you when appropriate. If your project is confidential or you prefer not to be featured, tell us in writing before the session and we will respect it. We will never sell your images to third parties for their own use.
Artificial Intelligence and Resale
Delivered files may not be resold, licensed to others, sold as stock, or used to train, fine-tune, or build artificial intelligence or machine learning models without our written permission.
Model and Property Releases
When people, private property, artwork, or trademarks appear in your project, releases or permissions may be needed for commercial use. Unless we agree in writing to collect them, you are responsible for obtaining releases from the people and property owners you bring or control. We are happy to provide standard release forms on request. Where minors are involved, a parent or legal guardian must sign.
Use of This Website
You agree not to:
- Copy, download, scrape, or reuse images, video, or text from this site without our written permission.
- Use the site for anything unlawful, harmful, or misleading.
- Try to gain unauthorized access to the site or interfere with how it works.
- Submit false information or impersonate someone else through our forms.
- Send spam, malicious code, or automated requests.
Third-Party Links
This site may link to third-party websites and services. We do not control them and are not responsible for their content, policies, or practices.
Disclaimers
This website and its content are provided "as is" and "as available." We work hard to keep information accurate, but we do not guarantee that the site will always be complete, current, or error free. Creative results vary with conditions such as weather, light, locations, and the people involved, and specific results are not guaranteed except as stated in your agreement. Nothing on this site is legal advice.
Limitation of Liability
To the fullest extent allowed by law, Pint Sized Productions is not liable for indirect, incidental, special, or consequential damages arising from use of this website or our services. For any project, our total liability is limited to the amount you paid us for that project. If files are lost or damaged for reasons beyond our reasonable control, our responsibility is limited to a refund of amounts paid for the affected services. Some laws do not allow certain limits, so some of these may not apply to you.
Indemnification
You agree to defend and hold Pint Sized Productions harmless from claims, losses, and costs, including reasonable attorney fees, that arise from materials you provide to us (such as logos, music, footage, or scripts), from your use of deliverables outside your license, from missing releases or permissions you were responsible for, or from your violation of these terms.
Governing Law
These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts located in Virginia, unless your agreement provides otherwise.
Changes to These Terms
We may update these terms from time to time. The updated version will be posted here with a new effective date. Continuing to use the site after changes means you accept the updated terms.
